Modern pharmaceuticals can help people control their blood pressure, facilitate weight loss and delay the progression of debilitating medical conditions. It can be challenging to keep track of multiple drugs, their doses and when to obtain refills.

Patients trust the doctors prescribing their medication to recommend the right course of treatment and the pharmacist dispensing the drug to review and comply with the doctor's recommendation. Unfortunately, major pharmacy medication errors are relatively common.

Receiving the wrong dose or even the wrong medication from a pharmacy are among the most common pharmaceutical errors reported in the United States. They can have devastating consequences for patients and may require legal action to address.

The impacts of pharmacist errors

If a pharmacist erroneously provides the wrong medication to a patient, that mistake could trigger a cascade of medical consequences if the patient does not immediately identify the error. The wrong medication dispensed can disrupt treatment and cause serious reactions.

If the patient takes the medication, they might experience a variety of medical complications. The first is the loss of control over the treated condition, which may worsen without the actual prescribed medication.

The second is an adverse reaction to the drug provided by the pharmacist. The patient might have contraindications for that medication that make taking it dangerous. They may also be on other medications that interact with the drug that they should not have received.

The wrong dose from a pharmacy can be equally problematic, although for slightly different reasons. A pharmacist dispensing a low dose of a drug that requires a higher dose based on body weight might undermine the patient's treatment. Inappropriately low doses of antibiotics, for example, might result in an infection not only worsening but becoming resistant to treatment with similar medications. The patient may then require hospitalization to address their infection.

Providing a patient with an inappropriately high dose can lead to an overdose or even damage to organs. Medication mix-ups and dosage errors are easily preventable with appropriate procedures in the pharmacy. As such, they represent a deviation from best practices and may constitute medical malpractice.

Patients affected by pharmacy errors may have questions about their legal rights. To protect themselves, they generally need to keep the incorrect medication (but put it where it won’t mistakenly be used), maintain written records of any adverse side effects and report the issue to the pharmacist. They may also need to seek medical attention and then consult with an attorney after addressing the immediate medical consequences of the error.

A major medication error that a pharmacist should have been able to avoid could be medical malpractice in Ohio if it caused harm to the patient. Reviewing the dispensing error that occurred and the impact that it had on the patient can help impacted parties hold pharmacists accountable through a medical malpractice lawsuit.

For many persons, a family doctor is a fixture of your life. They have guided you through important moments, prevented you from serious issues and in some cases, even delivered your children.

But when that deep-rooted trust is broken by a medical error, the emotional aftermath can be as painful as the physical injury itself. You may feel a mix of guilt and hesitation, wondering if taking legal action is disloyal to someone you once trusted.

Validating your experience

At the Law Office of Michael Goldstein, we want to validate those feelings. We often hear from seniors who were made to feel that their symptoms (chronic pain, sudden fatigue, or cognitive changes) were simply "part of aging," when they were actually red flags of a misdiagnosis or a neglected medical error.

Although you may feel guilty at times, it is worth stating that this was not your fault. You trusted a professional to listen, and they failed to meet the standard of care you deserved. Feeling hurt and angry is not a sign of disloyalty, but a natural response to a breach of the standard of care.

Reframing justice as protection

Holding a doctor accountable is not about putting them in their place or being vindictive. It is about two fundamental things:

Your right to heal: Recovery is expensive. You deserve the resources to pay for medical bills and corrective care.

Protecting others: By speaking up, you may prevent another Cleveland family from suffering the same mistake.

According to the state code, you can file a lawsuit within one year of whenever the medical error happened.

Time is a critical factor in Ohio medical malpractice law. Under state law, you generally have one year from the date the error occurred (or was discovered) to file a lawsuit. Because these cases require a complex Affidavit of Merit from medical experts before they can even proceed, early investigation is essential.

We help you speak up

At [nap_names id="FIRM-NAME-3"], we understand that you are already carrying enough. You are dealing with physical recovery and emotional weight. Our role is to be your voice. We step in to handle the paperwork, the experts, and the insurance companies so you can focus entirely on your well-being.

We also believe that your financial security should not be a barrier to justice. We operate on a contingency basis, meaning you pay nothing unless we recover compensation for you.

You deserve to be heard, and you deserve to be made whole. If you feel like your health was sidelined, let us help you stand up for your rights.

Diagnostic errors are a dangerous form of medical negligence in Ohio. It is important to stay vigilant and watch out for signs that indicate an incorrect diagnosis at best, or medical malpractice at worst. After all, you know your body better than anyone.

Dismissive doctors

Sometimes, doctors may dismiss symptoms as mere signs of stress or aging without appropriate testing. This means that they might miss serious conditions. In Ohio, this can potentially serve as evidence against them for medical malpractice.

Communication gaps

If a patient is not kept up to date concerning abnormal findings or the implications of their lab results, they might delay treatment and potentially worsen their condition.

The “rushed” ER

Emergency rooms are fast-paced environments, and many patients enter as quickly as they leave. Doctors and nurses might fail to properly diagnose their patients and even discharge them prematurely without proper stabilization.

Medication mismatch

It is a cause for alarm if a doctor prescribes you with the wrong drug or the incorrect dosage. Similarly, a sign of medical malpractice is if your health care provider either ignores or forgets about your allergies and interactions with other medications you are taking.

Surgical “surprises”

Doctors must always inform you about the dangers that come with any surgical procedure you must undergo. Health care providers have an obligation to inform you of any risks, pain, complications or side effects that might come with the procedure.

The second opinion

If a second doctor diagnoses a condition that the first doctor could not identify, this may be a sign of a diagnostic error. It may also be a sign of medical malpractice if it can be proven that a competent doctor in the same field would have been able to accurately diagnose the condition.

Seeking legal guidance for medical malpractice in Cleveland

Making sense of the complex laws concerning medical malpractice can be difficult without the help of a legal professional. If you suspect that you are a victim of medical malpractice, it is important to consult a specialized lawyer to help you gather the right evidence and file a claim.
